Welcome to the Verdant Health Commission (Verdant) Web site, verdanthealth.org (the “Site”).

The Verdant Health Commission is a program of Public Hospital District No. 2, Snohomish County (the “District”). In consideration of your use of the Site, you agree to the following General Terms of Use. We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms of Use at any time. Please check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes to these Terms of Use will mean you accept those changes.

Use of the Site

The material provided on Verdant’s Site is designed for educational and informational purposes only. It is provided with the understanding that Verdant is not engaged in rendering medical advice or recommendation. You should not rely on any information on the Site to replace consultations with qualified health care professionals to meet your individual medical needs. If you have, or suspect you may have, a health problem, you should consult your health care provider.

Materials on the Site, including text, graphics, photographs, images, sound, illustrations, videos, articles (“Content”), as well as the design and organization of the Site are owned by Verdant its licensors and/or its content providers and are protected by copyright, trade dress, trademark and other laws relating to intellectual property rights. The Site and the Content are made available for personal, informational, and noncommercial use only. Permission to otherwise reprint, copy, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, sell or electronically reproduce the Site, in part or in its entirety, is expressly prohibited, unless prior written consent is obtained from the rightful owner or Verdant. Links to Other Sites

When Verdant’s Web site includes links to other sites, Verdant does not assume any responsibility or liability for any communications or materials available at the sites to which it links, including responsibility or liability in their accuracy. No link on Verdant’s Site is a referral, affiliation or endorsement of either the linked-to entity or any product or service. Such links are provided for convenience only. Links are posted at the sole discretion of Verdant, in an effort to provide residents of South Snohomish County with useful and relevant resources.

Facilities and Events Listed

As a program the District, Verdant is focused on serving the residents of its district. As such, the facilities and events listed on the Site must be geographically located within the District boundaries or within one mile of the District’s boundaries. The District’s boundaries are: the King-Snohomish County line to the south, 148^th Street SW to the north, Puget Sound to the west and 3^rd Avenue SE to the east. A map of the District is located here. Community health events coordinated by an organization located within the District, but with the event taking place outside of the District, may be considered for inclusion. Events must be supporting the health and well-being of residents to be considered for posting. Events posted are at the sole discretion of Verdant.

Governing Law

This Website is created and controlled by Verdant in the State of Washington. These disclaimers, conditions and terms of use are governed by the laws of the State of Washington, excluding its conflicts of laws provisions. By using this Site, you hereby consent to the exclusive jurisdiction and venue of the state and federal courts located in Snohomish County, Washington in all disputes arising out of or relating to the use of this Site. If any portion of these Terms of Use are held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law to the greatest extent possible to reflect the original intentions of the parties, and the remainder of the provisions shall remain in full force and effect. Verdant’s failure to insist upon or enforce strict performance of any provision of these terms shall not be construed as a waiver of any provision or right.

Privacy Policy

Personal Information

Any personally identifiable information that you provide to Verdant through the Site, whether via survey, registration or e-mail, will be used exclusively by Verdant or third parties performing services for Verdant. Verdant will use your personally identifiable information only for the specific reason for which you submitted it, (i.e., registering for an event). You may receive e-mail containing information that you have requested or as confirmation of information that you submitted (i.e., event registration). Verdant may use aggregate data of users to improve the Site and enhance services. Verdant will not sell, share, or transfer any of your personally identifiable information to others, except with vendors and agents solely for the purpose of supporting Verdant’s activities.

Cookies

A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is not linked to any personally identifiable information while visiting the Verdant site. Once the user closes their browser, the cookie simply terminates. For instance, by setting a cookie on our site, the user would not have to log in a password more than once, thereby saving time while on our site. If a user rejects the cookie, he or she may still use our site. The only drawback to this is that the user will be limited in some areas of our site (i.e., cannot view certain content). Cookies can also enable us to track and target the interests of our users to further develop our Site. Verdant does not use Cookies to retrieve information from your computer that was not originally sent in a Cookie.

Collection of Anonymous Information

Verdant may also gather anonymous information which may be used by Verdant or shared with third parties. Generally this information is collected through “traffic data” and may entail the use of Cookies and IP addresses. Verdant uses such traffic data to help determine how our users use parts of the Site so we can analyze trends, administer the site, track user’s movement, gather broad demographic information for aggregate use to create a better experience for you. IP addresses and traffic data are not linked to your personally identifiable information.

Notification of Changes

If Verdant decides to change this privacy policy, we will conspicuously post a warning on our home page so that users will be aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it to any third parties. Verdant will use information in only accordance with the privacy policy in effect at the time the information was collected.

Social Media Policy

Purpose

To address the fast-changing landscape of the Internet and the way residents communicate and obtain information online, the Verdant Health Commission may use social media tools to reach a broader audience. Verdant encourages the use of social media to further the goals of Verdant and its mission, where appropriate.

Verdant has an overriding interest and expectation in deciding what is “said” on behalf of Verdant on social media sites. As such, this policy establishes guidelines for the use of social media.

Account Management

The Director of Marketing & Communications, with support from other staff as needed, will be responsible for the creation, content and upkeep of any social media sites. The Director of Marketing & Communications will designate appropriate staff to serve in a backup capacity. The creation of sites will be approved by the Superintendent.

Acceptable Use

Wherever possible, all Verdant social media sites shall comply with all appropriate policies and standards, including but not limited to the Email and Internet Policy and the website’s Terms of Use. Social media use is for business communication and for the purpose of fulfilling job duties, in accordance with Verdant goals and objectives, not for personal use.

Employee Conduct

Verdant social media sites shall comply with the Employee Handbook and administrative rules.

A summary of the key points of ethical social media conduct are included below:

Individual protection and respect are paramount.
We will use every effort to keep our interactions factual and accurate.
We will strive for transparency and openness in our interactions and will never seek to “spin” information for our benefit.
We will provide links to credible sources of information to support our interactions, when possible.
We will publicly correct any information we have communicated that is later found to be in error and apologize when appropriate.
We are honest about our relationship, opinions and identity.
We respect the rules of the venue.
We protect privacy and permissions.

Content

All content must be accurate and up-to-date, including source links whenever possible. The content posted by Verdant must also adhere to the Verdant Graphic Standards and Style Guide. See “Citizen Conduct” for information about acceptable commenting practices and the removal of content/comments.

Legal Issues

Verdant social media sites are subject to State of Washington public records laws and Verdant’s Records & Retention Policy. Any content maintained in a social media format that is related to Verdant business, including a list of subscribers and posted communication, is a public record. Verdant is responsible for responding completely and accurately to any public records request for public records on social media. Content related to Verdant business shall be maintained in an accessible format and so that it can be produced in response to a request. Wherever possible, such sites shall clearly indicate that any articles and any other content posted or submitted for posting are subject to public disclosure. Users shall be notified that public disclosure requests must be directed to Verdant’s Public Records Administrator.

Citizen Conduct

Users and visitors to social media sites shall be notified that the intended purpose of the site is to serve as a mechanism for communication between Verdant and members of the community. Verdant social media site articles and comments containing any of the following forms of content shall not be allowed:

Comments not topically related to the particular social medium article being commented upon;
Profane language or content or clearly “mean-spirited” comments
Content that promotes, fosters, or perpetuates discrimination on the basis of race, creed, color, age, religion, gender, marital status, status with regard to public assistance, national origin, physical or mental disability or sexual orientation;
Sexual content or links to sexual content;
Solicitations of commerce;
Conduct or encouragement of illegal activity;
Comments in support of or opposition to candidates for public office, other political campaigns or ballot measures;
Information that may tend to compromise the safety or security of the public or public systems; or
Content that violates a legal ownership interest of any other party.

These guidelines must be displayed to users and/or made available by hyperlink. Any content removed based on these guidelines must be retained, including the time, date and identity of the poster when available.

Verdant reserves the right to restrict or remove any content that is deemed in violation of this social media policy or any applicable law. Verdant will monitor any user-generated content as it chooses and reserves the right to remove content for any reason whatever, without consent.
